A client’s personal information is only collected when it is “reasonably necessary” to do so and is usually collected through information provided by you on your Breathe Skin Body Mind client information form and/or through promotions, competitions and consumer queries.

– Your credit card details for products, services and cancellation fees (if applicable)

Breathe Skin Body Mind collects personal information directly from you wherever possible, however sometimes we may collect personal information about you from a third party, e.g. a friend who has provided your details to us so we can send you a voucher, or a friend who has entered your name and email address as part of a competition.

– to contact you directly about Breathe Skin Body Mind, its products, special offers, samples and other promotions;

Unlike a situation where a third party is providing services to Breathe Skin Body Mind under Clause 2.2, Breathe Skin Body Mind Privacy Policy applies to Breathe Skin Body Mind website only and Breathe Skin Body Mind assumes no responsibility for information and content of third party sites.

Breathe Skin Body Mind takes all reasonable precautions to ensure that the personal information we collect, use and disclose is accurate, complete, up-to date and relevant. However, the accuracy of that information depends to a large extent on the information you provide.

Breathe Skin Body Mind is dedicated to keeping personal information secure and protected from misuse, loss, unauthorised access, modification, disclosure and interference.

Once Breathe Skin Body Mind no longer requires your personal information for the primary purpose it was collected for, Breathe Skin Body Mind takes all reasonable steps to destroy or de-identify the personal information.
5. Data Controllers and Processers
We are the data controllers as we are collecting and using your personal information. We use trusted third parties as our data processors for technical and organisational purposes, including for payments and email marketing. We make all reasonable efforts ensure our data processors are GDPR – compliant.
6. Marketing
Breathe Skin Body Mind complies with permission-based direct marketing requirements under the Act and the Spam Act 2003.
When collecting your personal information, we must request your permission to use that information to send you information on products and promotions or have our associates send you marketing material. We must also give you the opportunity to “opt out” of receiving such marketing material.
Where you indicate your consent, Breathe Skin Body Mind may enter your details into a database for the purpose of contacting you directly about the Breathe Skin Body mind salon, products, special offers, samples, consumer research and other promotions.
7. Competitions and Trade Promotions
The most frequent methods by which we collect your personal information is via bookings for salon treatments, your client form which is completed at your first salon visit, and through competitions or other promotions.
For the purposes of competitions and trade promotions, the following special conditions apply to the collection, use and disclosure of your personal information:
All entries become the property of Breathe Skin Body Mind (and any third parties conducting joint promotions with Breathe Skin Body Mind);
Winners’ details and a description of the prizes will be entered on a database to comply with record-keeping requirements of relevant Australian State and Territory trade promotion legislation; and
Your personal information may also be published in a newspaper or other media in accordance with the terms and conditions of each promotion.
8. Openness, Access and Correction
You can request information in general from Breathe Skin Body Mind about the sort of personal information we hold on you, for what purposes we hold it and how we collect, hold, use and disclose your personal information, by sending us a request addressed to the Owner.
If the information held is inaccurate, incomplete or not up to date you may request we correct the information. We may refuse to grant you access to the information if the Act permits or requires such refusal.

9. Transborder Data Flows
Breathe Skin Body Mind will only transfer personal data overseas in circumstances where it is permitted by the Act and the Amended Act.
10. Complaints

We take privacy complaints seriously. If you make a complaint, we will respond within seven (7) days to advise you of the person responsible for managing your complaint. We will try to resolve your complaint within fourteen (14) days. When this is not reasonably possible, we will contact you within that time to let you know how long we will take to resolve your complaint.
